Background Info
Police had suspected that this man was dealing drugs. They did not have enough evidence to get a search warrant to look through his home. So instead they waited until he put his trash out and looked through it. They found in the trash enough evidence to actually get a search warrant. He thinks that this goes against the 4th amendment of illegal search.
Courts Rulings
The court ruled with a 6 to 2 vote that this was completely constitutional and did not go against the 4th amendment. With the trash being placed out on the curb with numerous people being able to search at free will, they concluded that the trash was no longer his property.
Lasting Effect
Like most other 4th amendment cases, I think that this did not have much lasting effect other than, establishing the fact that trash is not property. I think this because all search adn warrant cases are different and require different factors when deciding them.
